FERPA — General Provisions and Rights
Enforced by: US Dept. of Education
Current as of August 21, 1974
Plain Language Summary
FERPA gives parents (and students over 18 or in college) the right to inspect and correct education records. Schools violating FERPA risk losing federal funding.
No funds shall be made available under any applicable program to any educational agency or institution which has a policy of denying, or which effectively prevents, the parents of students the right to inspect and review the education records of their students.
When a student reaches 18 years of age or attends a postsecondary institution, the rights accorded to and the consent required of parents under FERPA transfer from the parents to the student.
